A public organization is a non-profit association that is created to implement or protect the common economic, social, cultural, etc. interests of different groups of people.

To open a public organization requires two or more founders who meet the following requirements:

  • legal capacity;
  • the natural person (citizens of Ukraine, foreigners, stateless persons);
  • reaching the age of 18, for children and youth public organization - 14 years of age;

The public organization's own name cannot contain:

the name of the body of state power, the body of local self-government,

the proper name of the public association, the activity of which is prohibited in court;

the words "state", "communal" and their derivatives;

the name is identical to the already registered public organizations.

The name of an individual may be used in the title, provided that he or her heirs have given their written consent.

A subdivision of a foreign non-governmental organization is accredited without granting the status of a legal entity in accordance with Art. 20 of the Law "On Public Associations" and the Law "On State Registration of Legal Entities, Individuals - Entrepreneurs and Public Associations".

Also, in accordance with Article 38 of the Constitution of Ukraine and the Resolution of the Cabinet of Ministers of Ukraine of November 3, 2010 № 996 "On ensuring public participation in the formation and implementation of public policy", public organizations have the right to be members of the Public Council, city, district, district in the cities of Kyiv and Sevastopol state administrations.

Previously, the All-Ukrainian status of an NGO was necessary to conduct its activities outside the territory of the place of registration of the organization. Currently obtaining this status is not mandatory, but is carried out in order to increase influence in society. Obtaining the status of an All-Ukrainian public organization is possible if it has separate units in most regions of Ukraine, from 14 separate units.
